Lifetime Protective Order Upheld. Motion to Remove Dismissed

A client had previously obtained a lifetime protective order against a neighbor, a serious measure reserved for situations involving genuine threat. Despite the order being in place, the neighbor continued to violate its terms. Then, remarkably, that same neighbor filed a motion asking the court to set aside the protective order entirely.

Attorney Chris Spofford saw an opportunity in the neighbor’s own conduct. Chris developed the argument that the protective order could not be modified or removed precisely because the violations were so egregious. The very behavior that should have prompted compliance instead became the strongest reason to keep the order in place.

After thorough research supporting this position, Chris presented the case to the court. The judge agreed, and the neighbor’s motion was dismissed. The lifetime protective order remains fully in effect, and our client’s safety remains protected.
